1. Who we are
This website, spanish-healthinsurance.com (the "Website"), is owned and operated by Stephen Paul Gregory, an individual insurance agent established in Spain, acting as an Exclusive Insurance Agent of Sanitas S.A. de Seguros.
- Registered address: C/ Alcalde Clemente García 19, 5, 30169 San Ginés, Murcia, Spain
- NIE: Y2155969D
- DGSFP registration: C0320Y2155969D (Dirección General de Seguros y Fondos de Pensiones)
- Email: info@spanish-healthinsurance.com
Throughout these terms, "we", "us" and "our" refer to Stephen Paul Gregory trading as Spanish Health Insurance. "You" and "your" refer to any person who visits the Website or engages our services.
2. Scope & acceptance
These terms and conditions (the "Terms") govern your access to and use of the Website and any enquiry, quote or policy-placement service we provide through it. By using the Website or requesting a quote, you confirm that you have read, understood and accepted these Terms.
If you do not accept these Terms, you must stop using the Website.
3. Our role as insurance intermediary
We operate as an exclusive insurance agent within the meaning of Royal Decree-Law 3/2020 of 4 February, which transposes the EU Insurance Distribution Directive (IDD), and Law 20/2015 (LOSSEAR) on the regulation, supervision and solvency of insurance undertakings.
This means:
- We distribute health-insurance products of Sanitas S.A. de Seguros only.
- We do not compare products from multiple insurers.
- We act on behalf of the insurer, not as an independent broker.
- Our registration and legal status can be verified with the DGSFP at www.dgsfp.mineco.gob.es.
4. Information provided on the website
The Website provides general information about Sanitas health-insurance products, prices, clinics, coverages, waiting periods and related topics for English-speaking residents and expats in Spain.
We make reasonable efforts to keep the content accurate and up-to-date, but:
- Descriptions of products, benefits, copayments, clinic networks and exclusions are a summary. The binding policy documents are the Conditions (General, Particular and Special) issued by Sanitas at the point of contracting.
- Prices and discounts shown are indicative and may change without notice.
- Third-party information (regulations, clinic details, government procedures) is included for context and may change independently of us.
5. Quotes & price validity
Any quote we provide is indicative and subject to:
- Confirmation of the information you supply, including age, residence, medical history and health declarations.
- Acceptance of your application by Sanitas.
- Application of any waiting periods, exclusions or loadings Sanitas may apply based on underwriting.
Unless otherwise stated in writing, a quote is valid for 30 days from the date it is issued. After that period the price may be re-quoted at current rates.
5.1 Indicative "from" prices
The "from" prices displayed on this Website are indicative only and are not binding quotes, contractual offers or guaranteed premiums. They represent the lowest available starting price for that plan under the most favourable underwriting circumstances and are provided solely as a general guide to help you compare plans.
Your actual monthly premium will be calculated individually by Sanitas and will depend on a number of factors including, but not limited to:
- Your age at the date of application — premiums increase with age across all plans.
- Your primary place of residence in Spain — pricing varies by province and municipality due to differences in local healthcare costs.
- Your declared health status and any pre-existing medical conditions — Sanitas may apply premium loadings, specific exclusions, or decline cover depending on your medical history.
- The plan, coverage level and optional add-ons selected — dental, optical or other riders will affect the final premium.
- The number of people to be covered — multi-member policies are priced per individual based on their own rating factors.
- Any underwriting decisions made by Sanitas, which are final and at their sole discretion.
Please note: Spanish Health Insurance accepts no liability for any difference between an indicative "from" price displayed on this Website and the final premium confirmed by Sanitas following full underwriting. Always request a personalised quote before making any financial decision.
6. Applying for a policy
To apply for a Sanitas policy through us, you must:
- Be at least 18 years old (or apply as the legal guardian of a dependant).
- Be a legal resident of Spain or, in the case of pre-residency policies, intend to become one. Certain products are available to applicants without a NIE at the quote stage.
- Provide accurate identity, contact and health information.
- Accept Sanitas' underwriting decision, which may include loading, exclusion or decline.
The contract of insurance is entered into between you and Sanitas, not between you and us. We facilitate and administer the application but are not a party to the policy.
7. Duty of disclosure
Under Article 10 of Spanish Insurance Contract Law (Ley 50/1980), you have a legal duty to answer truthfully and completely all questions we or Sanitas put to you regarding your circumstances and, in particular, your health. This includes pre-existing conditions, past surgeries, current medication, pregnancy status and any diagnosed illness.
Important: Providing inaccurate, incomplete or misleading information may allow Sanitas to reduce benefits, refuse a claim, or rescind the policy. If in doubt, disclose.
8. No advice & suitability
We provide information, quotes and distribution services. We do not provide regulated financial, legal, tax or medical advice. Any general guidance we share regarding plan features, copayments or add-ons reflects the characteristics of Sanitas products and not a personal recommendation tailored to your individual circumstances.
Before you contract, we will supply the Insurance Product Information Document (IPID) and the contractual conditions so you can decide whether the product meets your needs and demands. You are responsible for reading them before accepting the policy.
9. Commissions & remuneration
We are remunerated by commissions paid by Sanitas, included in the premium you pay. You do not pay us a separate fee for our distribution services. On request, we will provide more information about the nature and basis of the commission we receive in relation to your policy.
10. Premium payment
Premiums are paid directly to Sanitas by the payment method you authorise at the time of contracting (typically direct debit from a Spanish bank account, or an accepted credit/debit card, including international cards on certain products). Payment frequency, cancellation for non-payment and reinstatement are governed by the Sanitas policy conditions and Spanish insurance law.
11. Cancellation & cooling-off
For distance contracts, you generally have a 14-day cooling-off period from the later of (a) the date you enter into the contract or (b) the date you receive the contractual documentation, during which you may withdraw without penalty (Article 10 of Law 22/2007 on distance marketing of financial services to consumers). Thereafter, cancellation is governed by your Sanitas policy conditions and applicable law.
To cancel, contact us or Sanitas in writing using the details in the policy schedule.
12. Conflicts of interest
As an exclusive agent of Sanitas we recommend only Sanitas products; this is itself a potential structural conflict, which we disclose in advance. We maintain written procedures to identify and prevent conflicts of interest from adversely affecting clients. If a conflict cannot be managed, we will disclose it to you before contracting so you can make an informed decision.
13. Complaints & dispute resolution
If you are dissatisfied with our service or a Sanitas product sold through us, you may raise a complaint:
- In the first instance with us, in writing to info@spanish-healthinsurance.com. We aim to acknowledge within 5 working days and respond substantively within 2 months.
- With Sanitas' Customer Service Department (Servicio de Atención al Cliente) as indicated in your policy schedule.
- With the Sanitas Customer Ombudsman (Defensor del Cliente).
- With the Spanish insurance regulator, the Complaints Service of the DGSFP, once the insurer's internal process has been exhausted or two months have elapsed without a reply: www.dgsfp.mineco.gob.es.
